My boyfriend and I live together, and have a son. I am looking into leaving him and need to know what steps I need to take in order to get the child custody started. Any help would be appreciated!! Thanks in advance!

Try not to let it even get to court, try to work your own issues out on custody and support…if you cannot work them out amongst yourself than hire a lawyer and be prepared to spend a lot of money

It is best to go thru the courts to not only work out a child custody and visitation schedule, but also to have an order of child support put in place. Do not depend on him giving you money on a regular basis, which may be less regular if he meets someone else and eventually starts another family. Protect your child’s rights by going to court.
As an unwed mother you have default custody. What you need to do is file child support against him and then move out. Any time that you are living with him he is not obligated to pay for child support. Go to child support enforcement ONCE YOU MOVE OUT and file. The whole process should take about 6 months before you see a dime and that is IF they move quickly.
the easier way to do this is to sit down with him, tell him you are unhappy, and see if you can come up with an agreement on your own….THEN take that agreement to the court house and attach it to a motion that you are applying for joint custody and would like this agreement in place. It will go before a Judge and he/she can tell you and the father if it follows the state laws, and if it does then it can be made into a real order.
There are many child custody are available in texas. But it is too much better if your child will remain with you. But the age of your child is not mentioned.
