Avoid trying to go for sole custody. The court system is leaning heavily toward joint physical custody. As long as he doesn’t have proof that you are a bad parent you should do ok. Make sure you have character witnesses.

Question by spara: somebody has petitioned courts for guardianship of your children and you have sole custody what do you do?
how can a father who only has visitation rights give consent ? what if the courts grant her ( paternal grandmother) temp. guardianship until court? is it illegal to use deception to gain physical access or custody of the children? what do i do if temp. order has already been granted and the hearing isnt for another two weeks?

My husband and I are making out our wills and are considering not leaving our children to any of the grandparents. My husband’s parents are divorced and do not get along, so we’re afraid of bitter arguments between the two if either of them were to get custody. My parents are just downright unfit, and I have to VERY closely supervise my father when he is around my children, and will NOT leave him alone with him, even for 10 minutes, so they are out. We are considering some close friends, and I was just wondering if anyone else opted for friends instead of realatives. Also, if you did, did you tell the family members. I feel like I shouldn’t tell them, I don’t want to cause waves, this is only if we were to die, which we’re both very healthy, so it would only be due to an accident. On the other hand I don’t know that they would enjoy the “surprise” if we were to ever die.
Anyone do this? Any suggestions?

We also would not leave our children to our parents. Mine for what sounds like the same reason as yours (because of this I have no relationship with them at all) and my husbands because they show very little love to the kids at all. I would talk to the friends first before you put them in the will, after all what if they feel they couldn’t do it, what if you did that and then the grandparents threw fits and your friends gave over custody not knowing why you had named them guardians? I think that would be the right thing to do, however I am not sure that I would tell any of the grandparents about the decision but a letter to each of them to be presented in case of death only would explain to them your reasons for choosing your friends. This would also help prevent any problems for your friends.

My ex swears that it is illegal to name a gardian for your children in a will because it is considered slavery. I know that this is completely, retardedly, false. However, he will not believe me unless I have an answer that is credible. I am from Minnesota. He says that this includes several states. I have tried to research this matter several times on the internet but to no avail. I want to name a gardian for our daughter in my will. I think he is just trying to scare me into not going through with it though. What do you think?
My problem is that my ex believes stupid things people tell him and in his mind they are facts. I consider myself to be an educated person and in my mind they are hearsay until proven correct or incorrect. I just live for proving the retarded things that he says wrong.

I have full legal and physical custody of our daughter right now but if anything happens to me, I want to name a guardian other than my ex for my daughter. If anything happens to me, he wants custody of her. I want her to either stay were she is with my current husband and my other children, or I want her to live with my mother. She would be in the same school district and area either way. If she goes to live with her father, she would go to live in Wisconsin and he cares nothing for her future or a college education. He has asked me why I even talk to her about college because he never went to college and he is perfectly happy with his job. I want my daughter to go to college, get a good job, and be successful.

Your ex is nuts. If you don’t name a guardian, the state will do it for you. See an attorney right away.
