Drug use and mental illness are always factors the court considers when granting custody, you can file in either country and once the custody is granted US authorities will turn your child over to you based upon the order whichever court orders it.~

Question by babydoll: How hard is it for a father to win custody of a child when the mother has already lost the child to DSS?
This is a long story, so here goes. My husband just went to court to sign over the rights to a daughter to DSS that he stopped visiting due to threats from the mother many years ago. He found out in the court, that the mother lost the child due to abuse and neglect and the child was being molested. My husband was very upset that this happened to the little girl. And he feels like its his fault that it happened because he stopped visiting her.DSS now wants him to be in the child’s life and be a father to her, even if he can’t get custody. He is now getting his hopes up about getting full custody. I just want to know how hard the courts will be on us to get her. The girl is now 12 and really needs a good home and a father. This past father’s day she had a break down crying saying she wanted a daddy to love her. We both have stable jobs, we live a safe neighborhood, and we have a happy, healthy 15 month old child of our own. Can we win this case in court and get full custody of the girl?

If you do not have the permission of him, and/or the court, he can file a, injunction, as I advise fathers to do, to prevent the move until a full custody order is established with long distance visitation orders.

All Children Deserve Two Parents
Georgia Supreme Court Chief Justice Leah Ward Sears has noted, children born to unmarried women and to those in cohabiting relationships “must often overcome increased risks of poverty, education failure, child abuse, delinquency, emotional distress and mental illness.”…….the lack of a father’s guidance in children’s lives is a major cause of their suffering. “Marriage is the best child welfare, crime prevention, anti-poverty program we have,”

Question by childrenage11@yahoo.com: How would a mother feel if during a nasty child custody battle she loses custody of her daughter?
How would a mother feel if during a nasty child custody battle she loses custody of her daughter? She latter finds out that the father takes very good care of his daughter and she likes living with her father. The father does not interfere with the relation ship she has with the mother, but gives the mother more visitations that the courts will make him. She is a very good mother.
Best answer:
Answer by Baby Girl due May 21!
If she is a very good mother, I find it hard to believe that they would place custody with the father. Usually, courts rule in favor of the mom and therefore, she would likely have custody and visitation would be shared.
